1. Scope of application

1.1 The subject of these general terms and conditions is the purchase of products and services, carried out remotely via the Internet on the website "www.gls72.us", whose registered office is held by:

GLS72 SRL, whose registered office is located in Novafeltria (47863_RN), Località Torricella 315, VAT number 00175030410, hereinafter also referred to as "Supplier".

1.2 The following general terms and conditions of sale are an integral part of all supply contracts, even when orders are placed by telephone, verbally, by fax, by e-mail or via the Internet.

1.3 The following general terms and conditions of supply remain in force until their amendments are published on the website www.gls72.com and are not amended by the supplier. Deviating conditions are only valid and effective if expressly agreed in writing.

1.4 GLS72 srl markets the products listed on this site to private and professional customers (users understood as craftsmen, professionals, industries, wholesalers, retailers, etc.)

In the case of a sale to a professional, the latter guarantees that the purchase of the products is made exclusively for professional purposes.

In the case of a direct sale to a "consumer" (natural person acting for purposes unrelated to his professional activity), the relationship between GLS72 srl and its customer will be governed by the regulations for the protection of consumers, (Legislative Decree 206/2005, as integrated and amended by Legislative Decree no. 21 /2014).

2. Acceptance of the general conditions of sale

2.1 To purchase one or more products offered on the Site, it is necessary to obtain access identifiers by creating an Account in the dedicated section on gls72.us.

The contract stipulated between GLS72 srl and the Customer is considered concluded with the acceptance, partial or complete, of the order by GLS72 srl, by sending an order confirmation to the email address provided by the Customer containing a summary of the information already contained in the order form.

2.2 By placing an order by the various means provided on the site, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions of sale and payment.

2.3 If the Customer is a private consumer (i.e. a natural person who purchases goods for purposes unrelated to his professional activity), once the online purchase procedure has been completed, he will print or save an electronic copy and keep these general conditions of sale, in accordance with the provisions of articles 50 et seq. Legislative Decree 206/05 on distance selling.

2.4 Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or things, caused by the non-acceptance, even partial, of an order, is excluded.

2.5 The Customer is prohibited from entering false and/or invented and/or fictitious data in the registration procedure necessary to activate the procedure for the execution of this contract and the subsequent communications relating thereto; the personal data and the e-mail address must be exclusively real data of the Customer and not those of third parties, nor fictitious.

2.6 It is expressly forbidden to make double registrations corresponding to a single company/consumer or to insert third-party data. GLS72 srl reserves the right to pursue any violation and abuse, in the interest and for the protection of all consumers.

3. Purchasing conditions

3.1 The Customer may only purchase the products listed in the online catalogue of the gls72.us website at the time of the order, as described in the corresponding technical and information sheets. The technical information included faithfully reproduces that of the manufacturers.

GLS72 srl therefore reserves the right to modify the technical information of the products in order to adapt them to that provided by the manufacturers, without any prior notice.

All purchasing assistance information (glossaries, guides, etc.) is intended as simple generic information material. The image attached to a product sheet may not be perfectly identical in some of its characteristics but may differ in colour, size, accessory products from the photo.

3.2 Receipt of the order is confirmed by GLS72 srl by means of an e-mail response sent to the address provided by the Customer during the ordering procedure. The order confirmation email contains the following data

Order number and date: to be indicated in any possible communication with GLS72 srl

Product(s), quantity, price (with separate indication of the VAT applied for purchases made with a VAT number);

Type of payment chosen;

Shipping costs if the product does not have shipping included in the price;

Total amount of the order.

The message contains the data entered by the Customer, who undertakes to verify its accuracy and to promptly communicate any corrections, by any appropriate means.

3.3 The order confirmation will be sent within 24 hours of receipt of payment, it being understood that in the event of non-acceptance of the order, GLS72 srl will promptly inform the Customer.

3.4 All prices shown in the product sheets include VAT at the rate in force in Italy for private users. Users registered as a company will find the amount of the taxable base and the VAT deducted. For deliveries to non-EU countries, a separate price list without VAT will be applied.

4. Payment methods

The customer pays for the ordered goods using the payment methods indicated "online" at the time of purchase. Payment is considered valid if it is made directly to the supplier and accepted by the latter in the manner indicated in the order form, in any case in the currency indicated in the accounting documents. Any payment made in a manner different from that agreed will not be considered valid.

 

The following payment methods are available:

4.1 PAYPAL

 

Using this payment method, a page on the Paypal website will be displayed where the email and password of the Paypal account must be entered, or a new Paypal account can be created.

The amount will be debited from the account or credit or prepaid card associated with the Paypal account at the time of purchase of the order and the Customer will receive a confirmation email from Paypal.

In the event of cancellation, the amount will be refunded to the customer's Paypal account.

 

4.2 CREDIT CARDS

The credit cards that can be used are:

Visa;

Visa Electron;

MasterCard;

MasterCard Commercial;

 

The card used will be charged upon confirmation of the order.

The data relating to the Customer's credit card will be transmitted via a secure connection directly to the website of the banking institution that manages the transactions. These data will therefore not be stored or retained in any way by GLS 72 srl at the time the order is placed and confirmed.

If the customer, due to unforeseen needs, must communicate the credit card data to the Supplier, at his own decision, these will be retained in accordance with the provisions provided for by Legislative Decree 196/2003 and by European Regulation GDPR 679/2016 and subsequent integrations, and used exclusively for the purposes of the execution of the contract.

Under no circumstances can GLS72 srl be held responsible for the fraudulent and undue use of credit cards by third parties.

GLS72 srl reserves the right to request additional information from the Customer or the sending of copies of documents proving ownership of the card used. In the absence of such information, GLS72 srl reserves the right to cancel the order even if it is already confirmed, subject to the provisions of articles 2.5 and 2.6 above.

In the event of cancellation of the order:

by the Customer, it will only be possible until the delivery of the goods to the carrier

by GLS72 srl in the event of non-acceptance of the order, a refund of the amount paid by the Customer will be made.

5. Invoicing

5.1 Sales made on gls72.us are attributable to mail order sales and therefore without obligation to issue an invoice as provided for in article 22 of D.P.R. n.633/72, and without obligation to issue a receipt as provided for in article 2, letter oo) D.P.R. 21/12/1996 n.696.

5.2 The issuance of an invoice to a customer registered as an individual must be requested at the time of ordering by filling in the fields VAT number, tax code, Univocal code or Pec. Unless expressly requested, the customer who registers as an Individual only receives a purchase receipt.

The invoice will be sent to the customer by e-mail.

It is also specified that for sales to individuals for orders whose total value exceeds €3,600.00, no receipt will be issued, but the Tax Code will be requested for the issue of the invoice.

6. Method of dispatch and delivery

6.1 The delivery obligation lies with the Supplier who is required to dispatch the goods to the customer. GLS72 srl will deliver the ordered products to customers in the manner described in the previous article, through couriers and/or trusted carriers listed in paragraph 6.5.

6.2 The Supplier will carry out the packaging for the dispatch of the Products in the form deemed most appropriate. The packaging is carried out according to experience, unless the customer specifically requests, which must be made in writing in the order or by sending an e-mail to info@gls72.us. If a personalized packaging of the goods is requested, it is carried out against payment.

6.3 If the recipient is absent at the time of delivery, a notice will be left by the carrier. It is the customer's responsibility to monitor the tracking of his shipment by consulting the shipment tracking section in his personal account or through a link sent to his email inbox, in order to avoid stocks and to cooperate with Gls72 and the carrier to simplify delivery activities.

Unless otherwise agreed between the parties, the sales contract is executed within thirty days from the day following the day on which the customer sent the order to the supplier (art. 61 Legislative Decree 6/9/2005 no. 206). Delivery times may vary depending on the selected carrier and the delivery locations. If the customer refuses to receive the products made available to him in the aforementioned manner, the Supplier is nevertheless entitled to payment of the agreed price. In the event of failure to collect the products within five days of their being made available, the Supplier is entitled to deposit the products in a warehouse, at the customer's risk and expense. Delivery is carried out mainly by road carriers. However, no liability may be attributed to the supplier in the event of delay or failure to deliver due to force majeure or unforeseeable circumstances. The Supplier reserves the right to extend delivery times, without being in any way required to pay any compensation in the following cases: a) force majeure, such as strikes, lack or insufficiency of energy, fire in the Supplier's companies and/or any event not attributable to the latter; b) insufficiency, inaccuracy or delay by the customer in transmitting the information necessary for the execution of the order; c) any modification accepted by the Supplier after receipt of the order; d) difficulties in supplying raw materials.

6.4 GLS72 srl accepts orders with shipments in the Italian, European and non-European territory.

6.5 The goods, based on the destination and the service requested by the customer, will be delivered to the couriers with which we cooperate:

G.l.s Executive: for national shipments;

Fedex: for shipments in Europe and outside Europe;

UPS: for shipments in Europe and outside Europe;

TNT: for shipments in Europe.

The shipping costs of the goods are the responsibility of the Customer and, where applicable, are explicitly highlighted at the time of placing the order.

The goods are delivered to the destination address indicated when ordering.

6.6 The customer will receive a confirmation email of the shipment containing the tracking number, which is useful for monitoring the delivery of the goods purchased.

No liability can be attributed to GLS72 srl in the event of delays in processing the order or in delivery by the carrier, who has taken out appropriate insurance for damage, loss or theft of the goods entrusted to him, the details of which are reported in the contract concluded with GLS72 srl.

Delivery is scheduled to be made at street level, unless otherwise communicated at the time of ordering and accepted by GLS72 srl, for which a supplement may be charged compared to a standard delivery.

Upon delivery of the purchased products, the Customer is required to check that the packaging is intact, not damaged, not wet or altered even in the closing materials (adhesive tape and straps).

Any damage to the packaging must be reported immediately by affixing the words "RESERVE OF CONTROL" on the carrier's delivery note, specifying the reason for the reservation (for example: "perforated packaging", "crushed packaging", "open packaging").

Any problem regarding the physical integrity, completeness, accuracy of the products must be reported within 5 days of delivery by sending an email to info@gls72.eu.

7. Product availability

Warehouse stocks may not be synchronized in real time, so some products on the site may not currently be in stock.

In the event that the goods are not in stock, GLS72 srl will inform the Customer and restock from its supplier as soon as possible, guaranteeing shipment within 8 to 20 working days  from the date of the order, as we ship directly from Italy.

In cases where the Customer cannot wait for shipment, communication is necessary to the email address info@gls72.eu.

GLS72 srl will reimburse the amount paid. Under no circumstances will GLS72 srl. cannot be held responsible for the failure to send the ordered goods due to their temporary unavailability, with the consequent exclusion of the Customer's right to other compensation or indemnities.

8. Right of withdrawal

8.1 In accordance with the provisions of the Consumer Code (legislative decree no. 206 of 06/09/2005), as amended by legislative decree no. 21/2014, the Customer who is a consumer and, therefore, a natural person acting for purposes unrelated to its professional activity, has the right to withdraw from the purchase contract, without giving reason, within and at the latest fourteen days from delivery, or from the day on which the Customer or a designated third party by the latter, acquires physical possession of the goods purchased. In the case of several goods purchased with a single order, the withdrawal period runs from the day on which the Customer takes physical possession of the last good shipped.

8.2 The Customer who intends to exercise the right of withdrawal must send a written communication to Gls72 srl in the terms provided by law.

The communication of withdrawal will be considered validly communicated if it is sent by completing the appropriate return form available in the Customer's personal account on the website or on the home page under RIGHT OF WITHDRAWAL or by another explicit declaration ( registered letter, e-mail, etc.).

Upon receipt of the withdrawal declaration, GLS72 srl will contact the customer and communicate authorization to proceed with the return. Returns that have not been authorized by Gls72 srl are not accepted.

8.3 The right of withdrawal is subject to the following mandatory conditions

the Customer can exercise the right of withdrawal only and exclusively on the entire product; it will not be possible to exercise the right of withdrawal only on part of the product

the purchased product must be returned in its original packaging, complete with all accessories and documentation; Affixing labels and adhesive tapes directly to the original product packaging should be avoided

the product must be returned in perfect condition; products showing signs of damage, wear or dirt will not be accepted;

the right of withdrawal cannot be exercised on products made to measure or clearly personalized.

The right of withdrawal is lost if the Customer does not return the goods to GLS72 srl within 14 days from the date on which he communicated his withdrawal. The deadline is considered to have been met if the customer ships the goods before the expiration of the 14-day period.

The right of withdrawal is also lost in the event of a substantial defect in the returned product (absence of internal packaging and/or documentation and/or original packaging from the manufacturer; absence of integral elements and accessories of the product; damage; unsuitable return condition).

In all cases of forfeiture of the right of withdrawal, GLS72 srl will make the goods available to the Customer so that he can collect them at his own expense from the premises of GLS72 srl.

In case the goods are damaged during the return, GLS72 srl. will inform the Customer in order to allow him to file a complaint against the carrier chosen by him and to obtain reimbursement of the value of the goods, if they are insured; then, GLS72 srl will make the product available to the Customer, canceling the withdrawal.

8.4 On arrival at the warehouse, the goods will be inspected to assess damage, alterations and the absence of parts of the product not resulting from transport. If the packaging and/or packaging is damaged, GLS72 srl may retain a percentage not exceeding 10% of the value of the product, as a contribution to repair costs.

The Customer is responsible for any reduction in the value of the products due to handling other than that necessary to establish the nature, characteristics and functioning of the goods. In these cases, GLS72 srl reserves the right to invoice the buyer for the loss in value noted.

After verification of the returned merchandise, GLS72 srl will proceed with the reimbursement by crediting the same payment method used for the purchase (in the event of a bank transfer, bank details will be requested in order to make the credit. In accordance with article 56 of the Consumer Code, the reimbursement period by the Seller is 14 days from receipt of the withdrawal notification.

The refund may be withheld beyond 14 days until proof is provided by the Consumer that the goods have been returned or the goods have been received by the Seller.

9. Guarantees

9.1 All products are covered by the manufacturer's warranty, under the terms established by the latter. This guarantee is limited to the item sold to the exclusion of any other service as well as any indemnity or compensation.

This warranty applies to the product which presents conformity defects and/or malfunctions which could not be detected at the time of purchase, provided that the product itself is used correctly and carefully, i.e. -meaning in accordance with the intended use and what is indicated in the technical documentation and in compliance with the various operating standards indicated therein.

On the other hand, the aforementioned warranty will not be applicable in the event of negligence, carelessness in the use and maintenance of the product, connection of the purchased items to electrical systems or any other type of connection that does not comply with standards. In the event that the complaint for defects or vices proves to be unfounded, since it is not a question of hidden manufacturing defects, but of damage due to incorrect and negligent use of the product, the Customer may, at his option

1) leave the damaged product to GLS72 srl without claiming any reimbursement

2) use the assistance and repair services offered by GLS72 srl not covered by the warranty

3) return the damaged product; in the cases referred to in points ii) and iii) above, transport and repair costs are the responsibility of the Customer.

The transport costs of the products to be replaced or repaired and of the replaced or repaired products are entirely the responsibility of the customer.

9.2 In the event of a lack of conformity, GLS72 srl will indicate, at no cost to the Customer, one or more service centers to repair the defect. In these cases, the Customer is requested to contact GLS72 srl at the email address mauro@gls72.com, which will provide all information regarding the support centers.

In the event of a lack of conformity, the private consumer Customer has the right to have the conformity of the goods restored free of charge by repair, replacement, or an adequate reduction in the price or termination of the contract, according to the provisions of art. 130 of Legislative Decree No. 206/2005.

The time required to repair or replace the product depends exclusively on the manufacturer and the assistance center and no damage can be claimed from GLS72 srl for any delay.

9.3 In order to activate the product warranty, the customer must keep or print the invoice or receipt sent by email.

11. Processing of personal data (confidentiality)

GLS72 srl, in its capacity as data controller, is required to provide certain information regarding the use of personal data, such as the right to obtain confirmation of the existence or not of personal data concerning you at GLS72 srl; to know the source, logic and purposes of the processing; to obtain the updating, rectification and integration of data; to request the erasure, anonymization or blocking of illegally processed data; to oppose their processing for legitimate reasons or in the event of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication, it being understood that obtaining the cancellation of one's own personal data is subject to sending a written communication to GLS72 srl in the manner provided for in article 10 above.

If the customer has agreed to receive periodic Newsletters from GLS72 srl, he has the possibility to request at any time the cancellation of his personal data from the mailing list of GLS72 srl, which will be processed and executed, at the latest, 72 hours after receipt of the request.

12. Competences

This contract is governed by Italian law and for any dispute concerning the validity, interpretation or execution of the same contract, the Customer accepts the jurisdiction of the Italian State and, in any case, the application of the law Italian law in force at the time of the dispute, regardless of their domicile or seat, before the Court of Rimini. These general conditions of sale are governed by Italian law.

For the resolution of any dispute arising from the interpretation, execution and termination of the distance sales contract, if the Customer is a private consumer under the terms of article 66-bis of the Consumer Code, the Mandatory territorial jurisdiction is that of the judge of the consumer's place of residence, if located in Italy.  In all cases, the rules established by EC Regulation No. 44/2001, the Electronic Commerce Directive 31/00/EC and Legislative Decree No. 70 of April 9, 2003 apply.
